Notice on the Receipt and Processing of Responses in Cases of Overdue Responses to Documents Issued by the IP Vietnam

The Intellectual Property Office issued Notice No. 3297/TB-SHTT dated October 29, 2024 regarding the receipt and processing of responses in cases where the time limit for responding to documents of the Office has expired.

Recently, due to technical issues, a number of documents related to the examination of industrial property applications issued by the Intellectual Property Office (IP Office) were delivered to applicants after the deadline for response had already expired or with a shortened response period compared to the deadline stated in the documents. For such cases, the IP Office will handle them as follows:

The IP Office will receive the response documents, collect fees and charges, and process them as if they had been submitted within the prescribed time limit stated in the documents. For the purpose of handling these cases, the starting date for calculating the response time limit shall be the mailing date indicated by the postmark on the envelope, instead of the issuance date of the document.
