Intellectual Property Office of Vietnam Issues Notice on Expiry of Circular No. 43/2024/TT-BTC

The Intellectual Property Office of Vietnam issued Notice No. 4090/TB-SHTT dated December 31, 2024 regarding the expiry of the effectiveness of Circular No. 43/2024/TT-BTC dated June 28, 2024 of the Minister of Finance.

Circular No. 43/2024/TT-BTC dated June 28, 2024 of the Minister of Finance, which prescribes the collection rates of certain fees and charges with the aim of continuing to remove difficulties and support production and business activities, expires as of January 1, 2025. Accordingly, following Notice No. 1884/TB-SHTT dated June 28, 2024 on the implementation of Circular No. 43/2024/TT-BTC, the Intellectual Property Office of Vietnam hereby announces as follows:

1. From January 1, 2025 onward, the collection rates of industrial property fees and charges shall be applied in accordance with Circular No. 263/2016/TT-BTC dated November 14, 2016 of the Minister of Finance, which provides for the rates, collection regime, management, and use of industrial property fees and charges.

2. For applications submitted via online public services, from January 1, 2025 to December 31, 2025, industrial property fees shall be collected in accordance with Article 3 of Circular No. 63/2023/TT-BTC dated October 16, 2023 of the Minister of Finance, which amends and supplements certain provisions of circulars on fees and charges to encourage the use of online public services. Accordingly, organizations and individuals submitting applications or dossiers online for the provision of industrial property protection services—including: filing applications for industrial property protection; grant of Protection Titles; issuance of certificates of registration of industrial property rights assignment contracts; maintenance, renewal, termination, or invalidation of Protection Titles; issuance of industrial property representative practicing certificates; and publication and recording of industrial property representatives— shall be subject to a fee rate equal to 50% (fifty percent) of the fee rates stipulated in Section A of the Schedule of Industrial Property Fees and Charges promulgated together with Circular No. 263/2016/TT-BTC.

3. For cases where notices requiring payment of fees were issued by the Intellectual Property Office of Vietnam prior to January 1, 2025, the payable fees shall be collected in accordance with the rates specified in those issued notices.
